Are we using international law or American law?
Because the US constitution really cannot be invoked as a reason if we are using international law. |

The right to silence has its origins in common law, which arose in medieval England. Most civilizations recognize the right to protect oneself against
self-incrimination.

Did I make any objection to the AoX telling Xena to shut up?
Nope! It's perfect! Like I've said, this trial is primarily a test of the AoX as far as I'm concerned. Maybe not the one they think tho - I'm not interested in how clever their trial strategising is, I'm testing their Values and Ethos. See if Xena says 'Yes I was wrong, I regret the awful things I did', which we all know is true, it shows up the hypocrisy of the AoX doing those very things in her name. Hence - the AoX cannot allow Xena to testify!

As regards Xena, everybody who watched the show knows Xena is guilty of appalling crimes, Xena never chickened out of facing that. There should be no question
of her being found Guilty (tho I doubt she will be).
The only interesting aspect of the trial would be the Sentencing, if it gets that far. Gabrielle's Defence of Xena was never that she's Innocent, it was that she's changed. Gabrielle knew Xena had done awful things, but loved her and believed in her anyway. (That's one the things that made Gabrielle so uniquely important to Xena). Gabrielle knew Xena had faced her own guilt and already 'rehabilitated' herself in other words, and is now actively atoning and making the world a better place. So the Greater Good is served by Xena continuing to do that. Which the Prosecution agrees with, of course, for Gabrielle is very wise. But that's a Sentencing issue, doesn't change the fact that Xena is Guilty! Instead it asks us to consider what's the point of punishing someone who has already rehabilitated herself and is making restitution? Is justice about Rehabilitation or Vengeance? Which is The Greater Good? The show itself always came down on the side of Rehabilitation (until FIN Of course the AoX think Xena is Perfect, so EvilXena had no need to rehabilitate, so that gives them another quandary.... So they have to take the tack that Xena is Innocent. The notion of a Guilty Xena who turned her back on her awful past just blows the heart out of their barmy credos, and exposes their "We love all of Xena" mantra for what it is. An excuse to indulge themselves in Warlord Wannabeism. Where-as Gabrielle showed unconditional love, she saw Xena's faults and loved her anyway. |

Erm, shouldn't the prosecution have delivered to the Court a statement, or list, or whatever, of specific charges against the Defendant?? I mean, if
we're all making opening arguments, the defence needs to speak about how this, this, and this, charge will be proved to be false, etc.
How can they do that if they haven't seen the charges yet?? Seems to me that formal charges are presented at the Preliminary Hearing (i.e. right here!), and the judge makes a decision about whether a trial will be warranted...?????
